If my neighbor has a fire that does some damage to my apt./belongings, will the neighbor is renters insurance cover my damages or will my own renters insurance cover my damages?

It could be handled either way. My suggestion is that you just pay your deductible and let your insurance handle it.

If he causes a lot of damage to a lot of people, he may not have enough liability to cover everyone, and he probably wo not have the money to pay everyone out of his own pocket.

If its just your stuff that is ruined, your insurance company will get the money back from his insurance and refund your deductible.

Go ahead and file w/ your renters insurance. If it is a normal fire where it was accidental, he is not liable for the damage to your property, as it was an ACCIDENT not arson/intentional. Let the insurance carriers fight it out, that is what you pay them for. Renters insurance is to cover your belongings in situations just like these, that is why you have it.

The first thing u would do is to turn the claim in to ur own renters insurance company. If the fire was caused by the negligence of ur neighbor, ur company will subrogate (try to collect) from her insurance company. If she was not negligent & it was accidental (something shorted out or something like that) then ur insurance will pay for ur property & hers will pay for hers. In order for u to collect under ur neighbors liability under her policy, she has to be negligent in some manner..leaving a candle burning, pan on stove etc.
